0. Preamble
Vincent LARGOT EI, hereinafter referred to as the Service Provider, SIRE No. 401097027 – RCS Romans, located at 169 impasse de Malgras, 26170 Buis les Baronnies, is the provider of this website.
Internet users and the Service Provider are contractually bound only to the extent that the Service Provider makes available to users, within the framework of these General Terms and Conditions, an interface enabling them to conduct sales with the seller. The Service Provider is neither a representative, agent, nor intermediary for the Customers, nor is it an employee or employer of the seller.
1. Acceptance of the Terms and Conditions
The buyer’s acceptance of these Terms and Conditions is indicated by checking a box on the order form. Such acceptance must be full and complete. Any acceptance subject to conditions is deemed null and void. Buyers who do not agree to be bound by these Terms and Conditions must not place an order on the website.
2. Products
The photographs illustrating the products are not contractually binding. If errors occur in these photographs, the seller shall not be held liable under any circumstances. All products presented on the website are offered subject to availability from the seller and its suppliers.
The seller shall not be held liable for out-of-stock items.
3. Order
Automatic order-processing systems shall be deemed proof of the nature, content, and date of the order. The Customer will receive an order confirmation at the email address provided. The sale shall not be considered finalized until such order confirmation is received. The seller reserves the right to cancel any order from a Customer with whom there is an outstanding dispute regarding payment for a previous order. The buyer warrants that all information provided in the order form is accurate, up-to-date, and truthful, and is not misleading in any way. The buyer is informed and agrees that this information serves as proof of their identity and is binding upon them as soon as it is validated. The buyer must ensure that the contact information provided when placing the order is correct and that it allows the buyer to receive the order confirmation email.
If the buyer does not receive this email, they must contact the Seller using the contact information provided above. The order confirmation is deemed to have been received by the buyer once they are able to access it.
4. Retention of Title
The products ordered remain the property of the Seller until full and final payment of their price (Law of May 12, 1980).
5. Price
The selling prices of the products are displayed on the website in euros, excluding VAT pursuant to Article 293 B of the General Tax Code, and do not include the shipping costs applicable to the delivery of the products. The price indicated in the order confirmation is the final price, including shipping and handling costs based on the recipient’s location.
All orders, regardless of their origin, are payable in euros.
The seller reserves the right to change its prices without notice and at any time, but agrees to apply the current rates that were indicated to the Customer at the time of the order.
6. Availability
The seller accepts orders subject to product availability. The Customer is informed of product availability on the product information page. If, despite the Seller’s best efforts, an ordered product is unavailable, the Customer will be notified by email as soon as possible, and an appropriate solution will be offered, such as: a new estimated availability date for the product, an exchange of the unavailable product for another product, or a refund for said product. In this case, the seller will issue a refund via credit card or bank transfer to the name and address of the Customer who placed the order.
7. Payment
The price charged to the Customer is the price indicated on the order confirmation sent by the seller.
The price of the products is payable in full on the day the order is placed. Payment may be made by credit card bearing the CB logo or by bank transfer; any bank fees are the responsibility of the Customer. Checks must be made payable to the Seller and sent to the Seller’s address.
An order is held for 10 days. If payment is not received within this period, the order is canceled.
The order will be processed only upon receipt of payment and after validation.
Payment is processed directly on the bank’s server in a secure environment without passing through the store’s server.
In the event that the relevant bank payment centers decline the payment, the order will be automatically canceled after 15 days, and the Customer will be notified by email.
8. Delivery
Orders are delivered by the seller to the destinations listed in the shipping and handling fee schedule at the rate indicated based on the weight bracket of the total order.
For other destinations, please contact us for a quote.
After order confirmation, deliveries are made by the postal service or by the carrier selected by the customer at the time of ordering. Packages are delivered to a mailbox or a package pickup location.
For deliveries outside mainland France, the Customer agrees to pay all taxes due upon importation of the products, including customs duties, value-added tax, and any other taxes required under the laws of the country receiving the order.
The seller is hereby released from any legal liability if the customer fails to pay these taxes. Any delays do not entitle the buyer to claim damages.
Delivery times are provided for informational purposes only and are in no way guaranteed by the seller.
In the event that delivery fails due to an incorrect or incomplete address provided by the buyer, additional charges may be imposed on the buyer,
Always check your package upon arrival. In the event of delivery by a carrier or in-person delivery, and if damage or missing items are discovered, the buyer must note the issue in writing on the delivery receipt and confirm it to the seller by email within 48 hours.
In the event of apparent defects, the buyer has the right to return the item under the conditions set forth in this document.
The seller disclaims all liability regarding delivery in the following cases:
- Return of a package due to an incorrect or incomplete address: the package may be reshipped at the customer’s request, in which case the buyer will be billed for the new shipping charges,
- Packages returned because they were not picked up within the time limit specified by the delivery service provider (such as Relais Colis): the package may be reshipped at the customer’s request, and the customer will be billed for the new shipping charges.
Regarding lost packages, please refer to the legal information available on the government website: https://www.service-public.fr/particuliers/vosdroits/F10037
9. Complaints and Product Returns
Product returns may only be made with the seller’s prior approval.
Claims regarding products must be submitted via email (or by certified mail to the seller’s address).
Products ordered on the website may be returned if they do not match the order placed through our services or if they are defective. These products must be returned in their original packaging, and the defect must be described along with the order reference number.
Products will not be replaced if they have been used, opened, or degraded due to use, or if they are incomplete or damaged.
The product must be returned within 14 days of receiving the package, as evidenced by the postal receipt.
Upon receipt of the product in good condition and after inspection, the seller will, at your discretion, either exchange the product or issue a refund for the product in question.
All refunds will be issued in the name and to the address of the Customer who placed the order.
However, in accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal, as well as any request for a refund, cannot be exercised when the product has been manufactured, modified, adjusted, or significantly customized at the buyer’s request in cases where the product is rare, originality, or personalization (engraving) requested by the buyer.
10. Withdrawal
You have 14 days (from the date of receipt of the products) to decide whether to keep them. In the event of an exchange or refund, return the product(s) in new condition in their original, undamaged packaging, along with any accessories, user manuals, and documentation, to the seller’s address, including the order reference number(s).
If you exercise your right of withdrawal, the seller is required to refund the amounts paid by the Customer, free of charge, with the exception of return shipping costs and original shipping costs. The refund is due within a maximum of 15 days.
11. Disputes
This contract is governed by French law. The seller shall not be held liable for damages of any kind—whether material, immaterial, or physical—that may result from the malfunction or misuse of the products sold. The same applies to any modifications to the products made by the manufacturers. The seller’s liability shall, in any event, be limited to the amount of the order and shall not be invoked for simple errors or omissions that may have remained despite all precautions taken in the presentation of the products. In the event of difficulties in the performance of this contract, the buyer may, before taking any legal action, seek an amicable solution, in particular with the assistance of:
a professional association in the industry, a consumer association, or any other advisor of their choice. It is noted that the pursuit of an amicable solution does not interrupt the “short period” of the statutory warranty, nor the duration of the contractual warranty. It is hereby noted that, as a general rule and subject to the courts’ discretion, compliance with the provisions of this contract relating to the contractual warranty requires that the buyer fulfill its financial obligations to the seller.
Complaints or disputes will always be received with attentive consideration, as good faith is always presumed on the part of anyone who takes the trouble to explain their situation. In the event of a dispute, the Customer shall first contact the company to seek an amicable resolution.
Failing that, the Seller’s Commercial Court shall have exclusive jurisdiction, regardless of the place of delivery and the accepted method of payment.
12. Warranty
In any event, the Seller shall not be held liable for non-compliance with the regulatory and legislative provisions in force in the country of receipt; the Seller’s liability is systematically limited to the value of the product in question, as of its date of sale, and this excludes any recourse against the brand or the manufacturer of the product.
In any event, the Customer is entitled to the statutory warranty against title defects and latent defects (Art. 1625 et seq. of the Civil Code). Provided that the buyer proves the existence of the hidden defect, the seller is legally required to remedy all resulting consequences (Art. 1641 et seq. of the Civil Code); if the buyer brings the matter before the courts, they must do so within a “short period” from the discovery of the hidden defect (Art. 1648 of the Civil Code). You can contact Customer Service by email
13. Extended Producer Responsibility (EPR)
In accordance with the provisions of Article L. 541-10-13 of the Environmental Code, the seller is registered with the French Agency for Ecological Transition (ADEME) under the following unique identification number (IDU): FR546729_01VYBG. This number guarantees that the seller fulfills its reporting and financial contribution obligations to the authorized eco-organization.
