0. Preamble

Cyberté Création SARL identified as follows, Siret 478 579 329 - RCS Romans, located at 169 impasse de Malgras - 26170 Buis les Baronnies, is the supplier of this internet site.
Internet customers and Cyberté Création are only contractually bound insofar as Cyberté Création makes available to customers, within the framework of these General Conditions, an interface enabling them to make sales with L'Atelier Bois. Cyberté Création is neither a representative, nor an agent, nor a mediator of the Customers, nor an employee nor an employer of L'Atelier Bois.

1. Acceptance of the conditions

When the Customer clicks on the "validate your order" button, he declares that he accepts the order and the entirety of these general conditions of sale fully and without reservation.

2. Products

The photographs illustrating the products are not part of the contractual field. If errors are introduced, in no case, the responsibility of L'Atelier Bois can not be engaged. All the products presented on the site are proposed within the limit of the available stocks of L'Atelier Bois and its suppliers.

L'Atelier Bois cannot be held responsible for stock shortages.

3. Order

The automatic recording systems are considered as proof of the nature, content and date of the order. The Customer receives on the e-mail address that he will have communicated the confirmation of his order. The sale will be concluded only after this order confirmation. L'Atelier Bois reserves the right to cancel any order from a customer with whom there is a dispute over the payment of a previous order. The information given by the buyer, during the order taking, engage this one: in case of error in the wording of the addressee's coordinates, the seller could not be held responsible for the impossibility in which he could be to deliver the product.

4. Reserve of property

The ordered products remain the property of L'Atelier Bois until the final and complete payment of their price (Law of May 12, 1980).

5. Prices

All product offers have prices indicated in euros. The VAT is not applicable according to article 293 B of the CGI.
The price indicated in the order confirmation is the final price, including postage and packaging depending on the recipient.

All orders, whatever their origin, are payable in euros.

L'Atelier Bois reserves the right to modify its prices without notice and at any time, but commits itself to apply the prices in force which will have been indicated to the Customer at the time of the order, subject to availability at this date.

6. Availability

L'Atelier Bois accepts orders within the limits of available stocks. The Customer is informed of the availability of products on the product information sheet. If despite the vigilance of L'Atelier Bois, an ordered product is unavailable, the Customer will be informed by email as soon as possible and a suitable solution will be proposed either: a new availability period for the product, an exchange of the unavailable product for another product or the reimbursement of the said product. In this case, Cyberté Création will proceed with the reimbursement by bank cheque in the name and address of the Customer who placed the order.

7. Payment

The price invoiced to the Customer is the price indicated on the order confirmation sent by L'Atelier Bois.

The price of the products is payable in cash the day of the effective order. The payment is made by credit card bearing the acronym CB, by bank or postal check issued by a bank domiciled in France, by bank transfer, by paypal, the possible bank charges being charged to the Customer. Cheques are to be made payable to Cyberté Création and must be sent to : Cyberté Création SARL, 169 impasse de Malgras - 26170 Buis les Baronnies.

An order is reserved for 10 days. Beyond this period, without receipt of payment, the order is cancelled.
The order will be treated only with reception of the payment and after validation.

Cyberté Création subscribes to the secure online payment system SPPLUS of La Banque Postale, as an approved distance selling merchant.

Payment is made directly to the bank's server in a secure environment without passing through the store's server.

In the event that the bank payment centers concerned refuse the payment, the order will be automatically cancelled and the Customer will be notified by e-mail.

8. Delivery

The orders are delivered by L'Atelier Bois for the destinations indicated by the scale of the carriage costs and packing and at the rate indicated according to the weight of the total of the order.

For other destinations, please contact us for an estimate.

After confirmation of order, the deliveries are carried out by the Post office.

For deliveries outside of metropolitan France, the Customer agrees to pay all taxes due on the import of products, customs duties, value added tax, and any other taxes due under the laws of the country where the order is received.

L'Atelier Bois et Cyberté Création is in fact released from any legal responsibility if the payment of taxes was not made by the Customer. Any delays do not entitle the buyer to claim damages.

Delivery times are given as an indication and in no way guaranteed by L'Atelier Bois.

If the delivery by the Post Office could not be made and the parcel returned, L'Atelier Bois reserves the right to refund the price, all shipping costs remaining at the expense of the Customer.

Always check your package upon arrival. In case of damage or missing the Customer must formulate reserves in writing on the delivery order and confirm these reserves to L'Atelier Bois by registered mail and by e-mail within 48 hours.

In the event of apparent defects, the purchaser profits from the right of return under the conditions envisaged in this document.

9. Complaint and return of the products

Any return of product can be done only after agreement of L'Atelier Bois.

The complaints concerning the products will be done by electronic mail or by registered mail to :

The products ordered on the site can be returned in case of non conformity with the order made by our services or in case of defect. These products must be returned in their original packaging, accompanied by the order form and mention the defect noted.

The products will not be replaced in case of use, opened or degraded due to its use, incomplete or damaged.

It is reminded that in case of damage, damage or missing, the customer must make his reserves on the delivery order of the carrier and notify L'Atelier Bois within 48 hours by registered letter. In the absence of justified reserves, L'Atelier Bois can refuse the replacement or the refunding of the product.

The request for withdrawal must be made within 14 days from receipt of the package, the post office slip being proof. You then have 14 days to return the product.

Upon receipt of the product in due form and after examination of the product, L'Atelier Bois will proceed, according to your choice, either to the exchange, or to the refund of the product concerned.

All refunds will be made using the same method of payment as for the purchase by Cyberté Création in the name and address of the customer who placed the order.

10. Withdrawal

With the exception of articles personalized and/or created especially for you, you have 14 days (from receipt of the products) to form an opinion. In case of exchange or refund, return the new product(s) in its (their) original packaging, undamaged, with all accessories, instructions and documentation to the following address

In case of exercising the right of withdrawal, L'Atelier Bois is obliged to reimburse the sums paid by the Customer, without any costs, except for the return costs. The refund is due within a maximum of 15 days.

11. Litigation

This contract is subject to French law. L'Atelier Bois cannot be held responsible for damages of any kind, whether material or immaterial or physical, which could result from a malfunction or misuse of the products sold. It is the same for the possible modifications of the products resulting from the manufacturers. The responsibility of L'Atelier Bois will be, in any case, limited to the amount of the order and could not be questioned for simple errors or omissions which could have remained in spite of all the precautions taken in the presentation of the products In case of difficulties in the application of the present contract, the purchaser has the possibility, before any action in justice, to seek an amicable solution in particular with the assistance :

the European mediation site which allows you to enter a claim form online.

a professional association of the branch, an association of consumers or any other council of its choice. It is reminded that the search for an amicable solution does not interrupt the "short period" of the legal guarantee, nor the duration of the contractual guarantee. It is reminded that as a general rule and subject to the appreciation of the Courts, the respect of the provisions of the present contract relating to the contractual guarantee supposes that the purchaser honors his financial commitments towards the seller.

Complaints or disputes will always be received with attentive benevolence, good faith being always presumed in the one who takes the trouble to expose his situations. In the event of a dispute, the customer will first contact the company to obtain an amicable solution.

Otherwise, the Commercial Court of Albertville is the only competent court, whatever the place of delivery and the method of payment accepted.

12. Guarantee

In all the cases L'Atelier Bois cannot be held responsible for non respect of the regulatory and legislative dispositions in force in the country of reception, the responsibility of L'Atelier Bois is systematically limited to the value of the product in question, value at its date of sale and this without possibility of recourse towards the brand or the company producing the product.

In any case, the Customer benefits from the legal guarantee of eviction and hidden defects (Art.1625 and following of the Civil Code). On the condition that the buyer proves the hidden defect, the seller must legally repair all the consequences (art.1641 and following of the Civil Code); if the buyer goes to court, he must do so within a "short period" from the discovery of the hidden defect (art.1648 of the Civil Code).
