0. Preamble

Cyberté Création SARL, Siret 478 579 329 - RCS Romans, located at 169 impasse de Malgras - 26170 Buis les Baronnies, is the provider of this website.
Internet customers and Cyberté Création are contractually bound only insofar as Cyberté Création provides customers, within the framework of these General Terms and Conditions, with an interface enabling them to make sales with L'Atelier Bois. Cyberté Création is neither a representative, agent or mediator of the Customers, nor an employee or employer of L'Atelier Bois.

1. Acceptance of conditions

When the customer clicks on the "validate your order" button, he declares that he accepts the order and these general terms and conditions of sale in full and without reservation.

2. Products

The photographs illustrating the products are not contractually binding. L'Atelier Bois cannot be held responsible for any errors that may have occurred. All products presented on the site are offered within the limits of available stocks of L'Atelier Bois and its suppliers.

L'Atelier Bois cannot be held responsible for stock shortages.

3. Order

Automatic recording systems are considered as proof of the nature, content and date of the order. The customer will receive confirmation of his order by e-mail. The sale will only be concluded after this order confirmation. L'Atelier Bois reserves the right to cancel any order from a Customer with whom there is a dispute relating to the payment of a previous order. The information provided by the purchaser when placing an order is binding: in the event of an error in the recipient's contact details, the seller cannot be held responsible for the impossibility of delivering the product.

4. Reservation of ownership

Products ordered remain the property of L'Atelier Bois until full payment has been received (Law of May 12 1980).

5. Price

All product offers are quoted in euros. VAT is not applicable in accordance with article 293 B of the French General Tax Code.
The price indicated in the order confirmation is the final price, including postage and packaging depending on the recipient.

All orders, whatever their origin, are payable in euros.

L'Atelier Bois reserves the right to modify its prices without notice and at any time, but undertakes to apply the current prices indicated to the customer at the time of the order, subject to availability on that date.

6. Availability

L'Atelier Bois accepts orders while stocks last. The Customer is informed of product availability on the product information sheet. If, despite the vigilance of L'Atelier Bois, an ordered product is unavailable, the Customer will be informed by e-mail as soon as possible and a suitable solution will be proposed, either: a new availability period for the product, an exchange of the unavailable product for another product or reimbursement of the said product. In this case, Cyberté Création will reimburse the customer by cheque made out to the name and address of the customer who placed the order.

7. Payment

The price invoiced to the Customer is the price indicated on the order confirmation sent by L'Atelier Bois.

The price of products is payable in cash on the day the order is placed. Payment may be made by credit card bearing the CB symbol, by bank or postal cheque issued by a bank domiciled in France, by bank transfer, or by paypal, any bank charges being borne by the Customer. Cheques should be made payable to Cyberté Création and sent to : Cyberté Création SARL, 169 impasse de Malgras - 26170 Buis les Baronnies.

Orders are reserved for 10 days. After this period, without receipt of payment, the order is cancelled.
The order will be processed upon receipt of payment and validation.

Cyberté Création subscribes to the secure online payment system SPPLUS from La Banque Postale, as an approved distance-selling merchant.

Payment is made directly to the bank's server in a secure environment, without passing through the store's server.

In the event that the bank payment centers concerned refuse payment, the order will be automatically cancelled and the customer notified by e-mail.

8. Delivery

orders are delivered by L'Atelier Bois to the destinations indicated in the postage and packing schedule, at the rate indicated according to the weight of the total order.

For other destinations, please contact us for a quotation.

After order confirmation, deliveries are made by La Poste. Colissimo are delivered to post offices.

For deliveries outside mainland France, the customer undertakes to pay all taxes due on the import of products, customs duties, value-added tax and any other taxes due under the laws of the country in which the order is received.

L'Atelier Bois et Cyberté Création accepts no legal liability for the Customer's failure to pay such taxes. Any delays do not entitle the purchaser to claim damages.

Delivery times are given for information only and are in no way guaranteed by L'Atelier Bois.

If delivery by the Post Office cannot be made and the parcel returned, L'Atelier Bois reserves the right to reimburse the price of the parcel, all shipping costs remaining the responsibility of the Customer.

Always check your parcel on arrival. In the event of damage or missing items, the customer must express reservations in writing on the delivery note and confirm these reservations to L'Atelier Bois by registered mail or e-mail within 48 hours.

In the event of apparent defects, the purchaser benefits from the right of return under the conditions set out in this document.

9. Claims and returns

All product returns must be approved by L'Atelier Bois.

Complaints concerning products must be made by e-mail or registered mail to :

Products ordered on the site may be returned in the event of non-conformity with the order placed by our services, or in the event of defects. These products must be returned in their original packaging, accompanied by the order form and mentioning the defect found.

Products will not be replaced if used, opened, damaged or incomplete.

It is reminded that in the event of damage or shortages, the customer must express his reservations on the carrier's delivery note and notify L'Atelier Bois within 48 hours by registered letter. In the absence of justified reservations, L'Atelier Bois may refuse to replace or refund the product.

The retraction request must be made within 14 days of receipt of the parcel, as evidenced by the post office slip. You then have 14 days to return the product.

Upon receipt of the product in due form and after examination of the product, L'Atelier Bois will proceed, according to your choice, with either the exchange or refund of the product concerned.

All refunds will be made using the same method of payment as for purchases made by Cyberté Création in the name and address of the customer who placed the order.

10. Withdrawal

With the exception of items personalized and/or created especially for you, you have 14 days (from receipt of the products) to make up your mind. In the event of an exchange or refund, return the new product(s) in its (their) original packaging, undamaged, accompanied by any accessories, instructions and documentation to the following address:

In the event of exercising the right of retraction, L'Atelier Bois is obliged to reimburse the sums paid by the customer, free of charge, with the exception of the cost of returning the goods. Reimbursement is due within a maximum of 15 days.

11. Disputes

This contract is governed by French law. L'Atelier Bois cannot be held responsible for damages of any kind, whether material, immaterial or physical, which may result from the malfunction or misuse of the products sold. The same applies to any product modifications resulting from manufacturers. The liability of L'Atelier Bois will, in any event, be limited to the amount of the order and cannot be held liable for simple errors or omissions which may have occurred despite all the precautions taken in the presentation of the products. In the event of difficulties in the application of the present contract, the purchaser has the possibility, before taking any legal action, of seeking an amicable solution, notably with the help of :

the European mediation site, where you can fill in an online complaint form.

a professional association in the sector, a consumer association or any other advisor of your choice. Please note that the search for an amicable solution does not interrupt the "short period" of the legal warranty, nor the duration of the contractual warranty. As a general rule, and subject to the discretion of the courts, compliance with the provisions of this contract relating to the contractual warranty assumes that the buyer honors his financial commitments to the seller.

Complaints or disputes will always be received with attentive benevolence, good faith always being presumed in those who take the trouble to explain their situation. In the event of a dispute, the customer should first contact the company for an amicable solution.

Failing this, the Albertville Commercial Court shall have sole jurisdiction, regardless of the place of delivery and method of payment accepted.

12. Warranty

In all cases, L'Atelier Bois may not be held liable for failure to comply with the regulatory and legislative provisions in force in the country of receipt. The liability of L'Atelier Bois is systematically limited to the value of the product in question, at its date of sale, without any possibility of recourse against the brand or company producing the product.

In any case, the customer benefits from the legal guarantee of eviction and hidden defects (Art.1625 and following of the Civil Code). Provided the buyer can prove the hidden defect, the seller is legally bound to repair all the consequences (art.1641 et seq. of the French Civil Code); if the buyer goes to court, he must do so within a "short period" from the discovery of the hidden defect (art.1648 of the French Civil Code).
